CITY ATTORNEY'S STATUS REPORT

RECOMMENDATION

LAWSUITS FILED BY OR AGAINST THE CITY OF MIAMI BEACH SINCE THE LAST REPORT:

1. ADAM BIDAS V. CITY OF MIAMI BEACH AND TREMONT TOWING Case No. 2025-047140-SP24 (County Court of the 11 th Judicial Circuit of Florida in and for Miami-Dade County)

This is a small-claims action against the City of Miami Beach and Tremont Towing. Plaintiff alleges that the City negligently misrepresented the maximum allowable towing rates, that he was towed too quickly, that the towing rate he was charged is allegedly unconstitutionally punitive, and that the City’s imposition of different rates for residents versus nonresidents violates the Equal Protection Clause. The Office of the City Attorney will vigorously defend this action.

2. FELISHA WILLIAMS V. MIAMI-DADE COUNTY AND CITY OF MIAMI BEACH Civil Action No. 1:25 cv-21662-MFE (United States District Court Southern District of Florida)

In this complaint, the plaintiff asserts claims under 42 U.S.C Sections 1983 and 1985 and Florida tort law against the City of Miami Beach and Miami-Dade County in connection with a police-related incident on October 19, 2022. The Office of the City Attorney will vigorously defend this action.
