A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE, IN THE FORM ATTACHED TO THIS RESOLUTION AS EXHIBIT “A”, AN UNDERGROUND PERPETUAL UTILITY EASEMENT, BY AND BETWEEN THE CITY (GRANTEE) AND SUNLAKE MIAMI PROPERTIES, LLC (GRANTOR), FOR USE OF A TEN (10) FOOT EASEMENT ON GRANTOR’S PROPERTY (2501 LAKE AVENUE), LYING ALONG THE EASTERLY 5 FEET OF LOT 1, BLOCK 2G, OF THE “3RD REVISED PLAT OF SUNSET ISLANDS”, RECORDED IN PLAT BOOK 40, PAGE 8, OF THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA (PUBLIC RECORDS), AND THE WESTERLY 5 FEET OF LOT 9, BLOCK 2, OF THE “SUNSET LAKE EXTENSION” PLAT, RECORDED IN PLAT BOOK 40, PAGE 23 OF THE PUBLIC RECORDS, CONTAINING APPROXIMATELY 2,000 SQUARE FEET (EASEMENT AREA), TO CONSTRUCT, OPERATE, MAINTAIN, AND UPGRADE WATER, SANITARY SEWER, AND STORM SEWER UNDERGROUND UTILITY INFRASTRUCTURES WITHIN THE EASEMENT AREA.

COMMISSION MEMORANDUM
RECOMMENDATION
The Administration recommends approving the Resolution.
BACKGROUND/HISTORY
SUNLAKE MIAMI PROPERTIES, LLC is the owner of the property located at 2501 Lake Avenue, Miami Beach, within the City’s municipal jurisdiction.
The City has a five (5) foot-wide easement along the west side of Lot 9, Block 2, according to the map or plat of SUNSET LAKE EXTENSION, recorded in Plat Book 40, Page 23, of the Public Records of Miami-Dade County, Florida; and a five (5) foot wide easement along the east side of Lot 1, Block 2-G, according to the map or plat of SUNSET ISLANDS, recorded in Plat Book 40, Page 8, of the Public Records of Miami-Dade County, Florida (collectively, the ”Platted Easement”), for a total 10-foot easement area containing approximately 2,000 square feet.
SUNLAKE MIAMI PROPERTIES, LLC wishes to grant the City said easements, for the installation of storm, sewer, and drainage infrastructure within the said ten (10) foot easement area (collectively, the “Platted Easement Area”), with the centerline of the Platted Easement Area, located approximately twenty-nine (29) feet from the west side property line.
The City also needs to install new water and sanitary sewer infrastructure deep underground within the Platted Easement Area; however, the language in the Platted Easement does not specifically reference the category of sanitary sewer or water. The owner has agreed to convey to the City a separate perpetual Easement, which includes sanitary sewer utilities as well as the categories of utilities referenced in the Platted Easement.
SUNLAKE MIAMI PROPERTIES, LLC is developing a new single-family home on the Property
and needs to provide private utility connections and other improvements, such as but not limited to sanitary sewer lateral, water line, electrical lines, pool piping, gas line, site drainage lines, irrigation lines, driveway, pavers, lighting, and landscape (other than sod/grass), “subject to Grantor securing all required permits and regulatory approvals, (collectively “Private Improvements”), located on the surface or just below the surface of the Platted Easement Area.

CONCLUSION The Administration recommends approving and authorizing the execution of the underground, non-exclusive Perpetual Utility Easement in the form attached as Exhibit ”A” to the Resolution.
