COMMISSION MEMORANDUM
RECOMMENDATION
The Administration recommends that the Mayor and City Commission set a Special City Commission Meeting for Friday, November 21, 2025, at a time convenient to the Commission, for the purpose of adopting the final budget amendment for Fiscal Year (FY) 2025.
BACKGROUND/HISTORY
Pursuant to Section 166.241(7)(c), Florida Statutes, municipalities may amend their adopted budgets within the fiscal year or within 60 days following the end of the fiscal year. Such amendments must be adopted in the same manner as the original budget, by Resolution or Ordinance, unless otherwise provided in the municipalityβs charter.
The Cityβs biennial General Election is scheduled for Tuesday, November 4, 2025, and the City Commission is expected to meet on Monday, November 10, 2025, to accept the returns of the General Election. If a Run-Off Election becomes necessary, it will be held on Tuesday, December 9, 2025, in accordance with the recently adopted Charter amendment.
Limitations on the November 10, 2025 Meeting
Pursuant to Section 38-4(c) of the City Code, any Commission meeting held between the date of the General Election and the Monday following the Run-Off Election is limited to accepting the returns of the General Election and/or addressing emergency matters, in accordance with Florida law and Section 2.05 of the City Charter. Therefore, no regular legislative items may be heard during that window unless the item is an emergency matter.
In addition, the Office of Management and Budget has advised that the necessary year-end financial data will not be available in time for the November 10 meeting. As a result, that meeting is not a viable option for adopting the final FY 2025 budget amendment.
Justification for Emergency Classification
Based on the statutory requirement in Section 166.241(7)(c), Florida Statutes, which imposes a deadline for budget amendments within 60 days of the close of the fiscal year (i.e., by November 30, 2025), the adoption of the FY 2025 final budget amendment is an emergency matter pursuant to Section 38-4(c). Accordingly, the Administration recommends, consistent with past practice, setting a special meeting to approve the FY 2025 final budget amendment as an emergency matter pursuant to Section 38-4(c). This will allow the Commission to lawfully consider and adopt the amendment during a specially called meeting prior to the statutory deadline.

CONCLUSION
To maintain compliance with State law, the City Charter, and the City Code, and to meet the financial reporting obligations of the City, the Administration recommends setting a Special City Commission Meeting on Friday, November 21, 2025, to approve the FY 2025 final budget amendment as an emergency matter pursuant to Section 38-4(c) of the City Code.
