A RESOLUTION OF THE MAYOR AND COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE, IN THE FORM ATTACHED TO THIS RESOLUTION AS EXHIBIT “A”, THE SOVEREIGNTY SUBMERGED LANDS EASEMENT (EASEMENT NO. 42998), BY AND BETWEEN THE CITY (GRANTEE) AND THE BOARD OF TRUSTEES OF THE INTERNAL IMPROVEMENT TRUST FUND OF THE STATE OF FLORIDA (GRANTOR), FOR A TERM OF FIFTY (50) YEARS, COMMENCING RETROACTIVELY ON SEPTEMBER 11, 2024, FOR THE NON-EXCLUSIVE USE OF A 10’ EASEMENT, HAVING AN EASEMENT AREA OF APPROXIMATELY 6,281 SQUARE FEET (EASEMENT AREA); SAID EASEMENT AREA LOCATED WITHIN A PORTION OF THE SUBMERGED LANDS OF INDIAN CREEK, TRAVELING ALONG AN EASTERLY/WESTERLY LINE, APPROXIMATELY PARALLEL TO W 60TH STREET, LYING IN A PORTION IN SECTION 14, TOWNSHIP 53 SOUTH, RANGE 42 EAST, MIAMI DADE COUNTY, FLORIDA, AS SHOWN ON THE FOLLOWING PLATS RECORDED IN MIAMI-DADE COUNTY, FLORIDA: THE BATH CLUB PROPERTY, RECORDED IN PLAT BOOK 40, AT PAGE 14; BEACH VIEW ADDITION, RECORDED IN PLAT BOOK 16, AT PAGE 10; AND THE AMENDED PLAT OF SECOND OCEAN FRONT SUBDIVISION, RECORDED IN PLAT BOOK 28, AT PAGE 28, AS MORE PARTICULARLY DESCRIBED IN THE EASEMENT, TO BE USED FOR THE CONSTRUCTION, INSTALLATION AND OPERATION OF A 36-INCH DIAMETER SEWER LINE RELATED TO THE INDIAN CREEK CANAL FORCE MAIN PROJECT.
