AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER 70 OF THE CITY CODE, ENTITLED “MISCELLANEOUS OFFENSES,” BY AMENDING ARTICLE II, ENTITLED “PUBLIC PLACES,” BY AMENDING DIVISION 2, ENTITLED “BICYCLING, SKATEBOARDING, ROLLER SKATING, IN-LINE SKATING, MOTORIZED MEANS OF TRANSPORTATION, ELECTRIC BICYCLES, MOPEDS, MOTORCYCLES, MOTORIZED BICYCLES, AND MOTORIZED SCOOTERS,” BY AMENDING SECTION 70-67, ENTITLED “PROHIBITED ACTIVITIES,” TO CLARIFY THE PROHIBITIONS RELATING TO MOTORIZED MEANS OF TRANSPORTATION BY PROVIDING AN EXCEPTION, ON A PILOT PROGRAM BASIS, TO PERMIT AN ADULT RIDING AN ELECTRIC BICYCLE WITH A CHILD TO OPERATE SUCH ELECTRIC BICYCLE ON THE BEACHWALK AND OTHER SPECIFIED AREAS UNDER CERTAIN CONDITIONS; AND PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE.

ANALYSIS
The attached ordinance is presented on first reading by the sponsor, Commissioner Laura Dominguez.
The City of Miami Beach is committed to ensuring the safety and accessibility of public pathways for all users, particularly in areas of high pedestrian traffic.
The City has adopted regulations to prohibit motorized means of transportation on various pedestrian-oriented pathways, including the Beachwalk, Baywalk, and Marina Baywalk, to reduce the risk of collisions and injuries.
If adopted, the proposed ordinance would provide, for a nine-month pilot program period, a narrowly tailored exception for adults supervising children on electric bicycles, subject to safety conditions.
