RECOMMENDATION

BACKGROUND/HISTORY

Vehicular noise disturbances, particularly noise emanating from vehicle muffler and exhaust systems, and the revving of engines, continues nearly unabated especially in heavily travelled corridors, which negatively impacts the quality of life, tranquility, and health of City residents. Of particular concern are noise disturbances occurring in and around residential areas, where such unreasonable and excessive noise deprives residents of the peaceful enjoyment of their homes, and severely disrupts their ability to sleep. Moreover, without effective remedial action, the ongoing unreasonable and excessive vehicular exhaust noise will lead to greatly decreased resident satisfaction, dangerous conditions, and erode public trust in the City’s ability to manage its roadways and public spaces effectively.

As such, Commissioner Laura Dominguez and I jointly sponsored Resolution No. 2025-33669 (with Commissioner Joseph Magazine as a co-sponsor), which my colleagues and I adopted on May 21, 2025, that requires the City Administration to enhance enforcement of illegal and excessive vehicular muffler and exhaust noise throughout the City, with a focus on 5th Street, 41st Street, 71st Street, and Collins Avenue. Moreover, as part of its enhanced enforcement efforts, the Resolution directed the Administration to develop ninety (90) day targeted and comprehensive plans to mitigate illegal muffler/exhaust noise in each of the aforementioned areas, beginning with 5th Street and adjacent portions of the MacArthur Causeway in proximity to residential buildings and high priority locations in the South of 5th area. The Resolution also directed the Administration to provide the Mayor and City Commission with monthly updates regarding the effectiveness of the enhanced enforcement efforts, including data collection and analysis, along with any additional or alternative measures that may be necessary to supplement or enhance enforcement efforts.

Accordingly, I would like to hear from the City Administration, and discuss with my colleagues, the status of the enhanced enforcement efforts overall, but in particular with regard to 5th Street and the South of 5th area. It is my understanding, based upon an update provided by the Police Department at the September 10, 2025 Public Safety and Neighborhood Quality of Life Committee meeting, that enhanced enforcement efforts are underway, but I would like a further update to discuss how these efforts are progressing, what actions have been taken to date to enhance enforcement, where the enforcement efforts have been concentrated, the effectiveness of the enhanced enforcement efforts, and whether any additional resources or actions are needed to ensure continued successful implementation.
