RECOMMENDATION

The City Administration (โ€œAdministrationโ€) recommends that the Mayor and City Commission (โ€œCity Commissionโ€) discuss and concur with the Administration immediately filing of a request for administrative proceedings, pursuant to Chapter 120, Florida Statutes, through the State of Florida Department of Transportation (โ€œFDOTโ€) regarding the recent FDOT mandate to remove the decorative (i.e. non-standard) pedestrian crosswalks on Ocean Drive and 12 Street (the โ€œCrosswalksโ€).

BACKGROUND/HISTORY

The City completed the construction of the iconic Crosswalks in October 2018. A ribbon-cutting ceremony for the Crosswalks was held on November 9, 2018.

On August 21, 2025, the Administration received a letter from the FDOT (Attachment A) identifying the Crosswalks as non-compliant and requiring the City to remove the pavement surfaces at the Crosswalks by September 4, 2025 or the FDOT would remove the Crosswalks and assess the City for the costs incurred in association with the removal of the Crosswalks. Moreover, the letter stipulated that the FDOT will pursue withholding of state funds as permitted by the law should the City decide not to comply. The letter provided that the City may request an Administrative Hearing pursuant to Chapter 120, Florida Statutes within 14 days of receiving the letter (September 4, 2025) regarding FDOTโ€™s decision on this matter. The Administration has the authority to file the request for the administrative hearing and intends to do so but wanted to provide the opportunity for discussion as the hearing and FDOT follow up actions may happen before the next scheduled meeting of the Commission.

CONCLUSION

The Administration recommends that the City Commission discuss and concur with the Administration direction to pursue, on an immediate basis, administrative proceedings, pursuant to Chapter 120, Florida Statutes, with regard to the recent FDOT mandate requiring the City to remove the Crosswalks by September 4, 2025.
