RECOMMENDATION
Please place the above item on the October 29, 2025 City Commission meeting agenda as a referral to the Land Use and Sustainability Committee (βLUSCβ).
BACKGROUND/HISTORY
Commercial establishments selling retail and/or packaged alcohol for offsite consumption have proliferated along portions of Lincoln Road, particularly east of Drexel Avenue. These alcohol sales diminish visitorsβ enjoyment of Lincoln Road and detract from the public health, safety, and welfare. Under Senate Bill 180, the City is currently preempted from proposing or adopting more restrictive or burdensome comprehensive plan amendments or land development regulations to restrict future packaged alcoholic beverage retail sales. In addition, the City cannot impose restrictions that would materially impact existing package liquor stores. However, the City could implement legislation to disincentivize new stores from selling packaged alcoholic beverages and to incentivize existing businesses to cease or abandon retail or packaged alcohol sales.
ANALYSIS
I would like the Land Use and Sustainability Committee (βLUSCβ) to consider amendments to the Comprehensive Plan and LDRs to disincentivize the commencement of new retail and/or packaged alcoholic beverage sales and to incentivize the abandonment or cessation of existing retail and/or package sales of alcoholic beverages by commercial establishments within the Lincoln Road corridor east of Drexel Avenue. These incentives may include density, height, and intensity bonuses; parking mitigation; and fee mobility or impact fee reductions or waivers for qualifying projects. To be eligible for the incentives, property owners could be required to record a covenant agreeing not to sell retail and/or packaged alcoholic beverages on the property.
