A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, REQUESTING, PURSUANT TO SECTION 2-256(E) OF THE CITY CODE, THAT THE INSPECTOR GENERAL CONDUCT AN AUDIT OF CONSTRUCTION AND DEMOLITION (C&D) DEBRIS HAULERS OPERATING WITHIN THE CITY FOR COMPLIANCE WITH THE PERMITTING AND COLLECTION FEE REQUIREMENTS SET FORTH IN SECTIONS 90-276 AND 90-278 OF THE CITY CODE, PROVIDED, THE INSPECTOR GENERAL MAY ELECT, IN HIS DISCRETION, TO EXCLUDE C&D HAULERS THAT HAVE BEEN THE SUBJECT OF AN AUDIT WITHIN THE PAST TWO YEARS.

WHEREAS, Sections 90-276 and 90-278 of the City Code establish permitting and fee requirements for persons and entities engaged in the collection and disposal of construction and demolition (C&D) debris within the City of Miami Beach; and

WHEREAS, C&D haulers are required to obtain a valid C&D collection permit and remit to the City twenty percent (20%) of their gross monthly receipts derived from such activities; and

WHEREAS, these requirements are intended to ensure accountability, promote fair cost recovery, and support the City’s solid waste management and environmental protection goals; and

WHEREAS, concerns have been raised regarding potential noncompliance by certain C&D haulers operating within the City, including underreporting of receipts or failure to obtain the required permits; and

WHEREAS, the Office of the Inspector General is empowered to conduct audits, investigations, and reviews of City programs, contractors, and franchisees to ensure compliance with applicable laws, regulations, and contractual obligations; and

WHEREAS, an audit of C&D haulers will help determine the extent of compliance with Sections 90-276 and 90-278, identify any deficiencies or enforcement gaps, and recommend corrective actions as necessary to protect the City’s financial and regulatory interests.

NOW. THEREFORE. BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby request, pursuant to Section 2-256(e) of the City Code, that the Inspector General conduct an audit of construction and demolition (C&D) debris haulers operating within the City for compliance with the permitting and collection fee requirements set forth in Sections 90-276 and 90-278 of the City Code, provided, the Inspector General may elect, in his discretion, to exclude C&D haulers that have been the subject of an audit within the past two years.
