A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DIRECTING THE CITY ADMINISTRATION TO UPDATE DEMOLITION STANDARDS TO ENSURE COMPLIANCE WITH STATE AND LOCAL CLEANLINESS STANDARDS AND TO PRESENT PROPOSED CODE AMENDMENTS TO THE CITY COMMISSION FOR FIRST READING AT ITS JANUARY 2026 MEETING.

WHEREAS, the City of Miami Beach is currently experiencing a significant volume of demolition within its municipal boundaries; and

WHEREAS, dust and sediment control during and after demolition, as well as the timely removal of construction and demolition debris, remain ongoing concerns that directly impact the health, safety, and quality of life of neighboring property owners; and

WHEREAS, in addition to protecting adjacent properties, it is equally critical to ensure that dust, sediment, and other demolition-related contaminants are prevented from entering the City’s waterways, including Biscayne Bay and the Atlantic Ocean; and

WHEREAS, the City’s Code Compliance Department currently enforces Chapter 58 (Property Maintenance) and Chapter 90 (Solid Waste) of the City Code, including provisions applicable to specialty contractors engaged in the removal of construction and demolition debris; and

WHEREAS, given the volume of current and anticipated demolition projects citywide, there is a

pressing need to establish more robust and enforceable standards–such as dust mitigation and sediment control plans, mandating the immediate removal of construction debris, and ensuring strict

compliance with permitting and operational requirements for construction and demolition haulers under Chapter 90; and

WHEREAS, there is also a need to review and update the fines and penalties associated with noncompliance, including failure to submit a dust mitigation plan, fairly to properly remove debris, and failure by haulers to obtain required permits or remit appropriate fees to the City.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby directs the City Administration to update demolition standards to ensure compliance with state and local cleanliness standards and to present proposed Code amendments to the City Commission for first reading at its January 2026 meeting.
