BACKGROUND/HISTORY

ANALYSIS

The proposed ordinance, sponsored by Commissioner Laura Dominguez, is submitted for consideration by the Mayor and City Commission.

Political campaign signs are an important form of political expression protected under the First Amendment, and the unauthorized removal, disturbance or tampering with campaign signs undermines the integrity of elections, interferes with political speech, and causes conflict among candidates, elected officials, residents, and others.

As such, the proposed Ordinance would establish clear and enforceable regulations to protect lawfully placed campaign signs from various forms of interference. Moreover, the Ordinance is intended to help safeguard the integrity of local elections, deter unlawful interference with campaign materials, promote respect for private property rights, and ensure that political expression within the City is protected from unauthorized disturbance or tampering.

Any violation(s) of the proposed Ordinance will be prosecuted by the City’s Municipal Prosecution Team (unless there is also a State law violation) and shall be punishable by up to sixty (60) days in the county jail.
