BACKGROUND/HISTORY
The attached Ordinance was prepared at the request of Commissioner Alex J. Fernandez.
The City of Miami Beach has established various agencies, boards, and committees whose memberships are comprised of volunteers appointed by the Mayor and City Commission.
Currently, Chapter 2, Article III of the City Code, entitled “Agencies, Boards, and Committees,” sets forth term limits for appointees of City agencies, boards, and committees. In relevant part, Section 2-22 of the City Code provides that those members appointed by the City Commission as a whole (“at-large appointees”) may serve as at-large appointees for no more than six years on any agency, board, or committee.
On June 25, 2025, the Mayor and City Commission amended Section 2-22 pursuant to Ordinance No. 2025-4742 to provide as follows:
At-large appointees other than those serving on land use boards (i.e., the Historic Preservation Board, Design Review Board, Planning Board, or Board of Adjustment) may be reappointed to any other agency, board, or committee as an at-large appointee following the completion of their term without the requirement to take a hiatus in between terms; and
A land use board appointee who has served six years may not be reappointed to any agency, board, or committee without first observing a two-year hiatus.
ANALYSIS
The Ordinance makes the following amendments to Section 2-22 of the City Code:
1. Provide that the term limits created under this section apply to six consecutive years of service by an at-large appointee on the same agency, board, or committee;
2. Strike the two-year hiatus requirement for an at-large appointee who has served 6 consecutive years on the same land use board, prior to appointment to any other agency, board, or committee; and
3. Clarify and restate the existing requirement that a two-year hiatus is required before an at-large appointee may be reappointed to the same agency, board, or committee.
