Terms of Service - Democracy

1. Acceptance of Terms

By accessing and using Democracy - The Agenda App ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Democracy - The Agenda App provides access to Miami Beach city government meeting agendas, video recordings, and related information. The Service includes:

Viewing meeting agendas and attachments
Watching meeting video recordings
Creating video clips from meeting recordings
Tracking agenda items of interest

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Promptly update any changes to your information
Accept responsibility for all activities under your account

3.2 Account Types

We offer different account types:

Free Account: Basic access with limited features
Verified Account: Enhanced features after email verification
PRO Account: Full access to all features with subscription

4. User Content and Conduct

4.1 Video Clips

When creating video clips, you agree to:

Use clips for lawful purposes only
Not create misleading or deceptive content
Respect the context of the original meetings
Comply with applicable fair use guidelines

4.2 Prohibited Uses

You may not:

Use the Service for any illegal purpose
Attempt to gain unauthorized access to the Service
Interfere with or disrupt the Service
Scrape or harvest data without permission
Violate any applicable laws or regulations
Export or re-export the Service in violation of applicable export laws

5. Subscription and Payment

5.1 PRO Subscription

PRO subscriptions are billed monthly at the current rate. By subscribing, you authorize us to charge your payment method on a recurring basis.

5.2 Price Changes

We may change subscription prices at any time. We will provide at least 30 days' advance notice of any price increases via email or through the Service. Price changes will take effect at the start of your next billing cycle after the notice period.

5.3 Payment Processing

We use third-party payment processors. Your payment information is subject to their terms and privacy policies. You are responsible for all applicable taxes related to your subscription.

5.4 Failed Payments

If payment fails, we will attempt to process payment again. After multiple failed attempts, your account may be suspended or downgraded. We will notify you before taking such action.

5.5 Cancellation

You may cancel your PRO subscription at any time. Cancellation will take effect at the end of your current billing period.

5.6 Refunds

We do not offer refunds for partial months. If you cancel, you will retain PRO access until the end of your billing period.

6. Content and Intellectual Property

6.1 Public Records

Meeting agendas, videos, and related documents are public records provided by the City of Miami Beach. We do not claim ownership of this content.

6.2 Service Content

The Democracy - The Agenda App interface, features, and functionality are protected by copyright and other intellectual property laws.

6.3 User Content

You retain ownership of content you create using the Service, such as titles, descriptions, and notes. Video clips are derivative works of public records. Your clips are private to your account. By creating content, you grant Democracy - The Agenda App a limited license to store and display such content solely for providing the Service to you.

6.4 DMCA Compliance

We respect intellectual property rights. If you believe content infringes your copyright, please contact us at support@democracy.cc with a detailed notice including identification of the copyrighted work and the allegedly infringing material.

7. Data and Privacy

7.1 Privacy Policy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

7.2 Data Portability

You may request an export of your account data at any time by contacting support.

7.3 Data Retention

We retain your account data while your account is active. After account deletion, we may retain certain data for legal compliance purposes for up to 7 years, after which it will be permanently deleted.

8. Beta Features

We may offer beta or experimental features. These features are provided "as is" and may be modified or discontinued at any time without notice.

9. Service Level and Maintenance

While we strive for high availability, we may occasionally perform maintenance that temporarily affects service access. We will provide reasonable notice of planned maintenance when possible.

10. Disclaimers

10.1 Service Availability

The Service is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation.

10.2 Content Accuracy

While we strive for accuracy, we cannot guarantee that all information is complete, current, or error-free. Official records should be verified with the City of Miami Beach.

10.3 Third-Party Services

We use third-party services (including payment processing) and are not responsible for their actions or policies.

11. Limitation of Liability

To the fullest extent permitted by law, Democracy - The Agenda App and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless Democracy - The Agenda App and its operators from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Miami-Dade County, Florida.

14. Modifications

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

15. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason. You may also delete your account at any time through your account settings or by contacting support.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
